Government lawyers have stated that a judge from the Court of International Trade overstepped his authority by ordering U.S. Customs and Border Protection to issue refunds to all companies that paid tariffs deemed illegal. This includes companies that did not file lawsuits in trade court.
In June, the government filed an appeal with the U.S. Court of Appeals for the Federal Circuit and submitted its opening brief recently. The brief references a Supreme Court case from June 2025 that limited the use of universal injunctions, which the government argues should apply in this situation.
The majority of the tariff refunds, amounting to $100 billion, have already been processed by Customs and Border Protection. The government has indicated that companies that have not filed lawsuits are still able to do so within the statute of limitations.
