The plaintiffs say the arrangement lets paying customers see market-moving comments about war, tariffs and other issues before the public does.
The lawsuit argues that the service violates the Constitution because official announcements should be available to everyone at the same time. It says the new offering, called Truth API, gives subscribers access milliseconds earlier and can charge Wall Street firms as much as $100,000 a month.
Trump Media & Technology, the parent company of Truth Social, rejected the claims and said fast access to information through subscription APIs is common in the industry. The company said critics are trying to use the courts to censor Trump and harm shareholders.
The case was filed by the Freedom of the Press Foundation and The Intercept in the Southern District of New York. It also targets Daniel Scavino and Natalie J. Harp, and asks the court to stop the paid service and to bar Trump from posting official government information exclusively on his own site.
